Privacy Policy
This Privacy Policy describes the processing of personal data by Unity Shield LLC in connection with noson.ch in accordance with the Swiss Federal Act on Data Protection (FADP / DSG).
1. Controller
The controller responsible for data processing via noson.ch is Unity Shield LLC, 30 N Gould St Ste N, Sheridan, WY 82801, USA (email: [email protected]). Unity Shield LLC operates in cross-border e-commerce without its own physical permanent establishment in Switzerland.
2. Provision of the website and IT security
When accessing noson.ch, technically necessary connection and log data (IP address, date and time, requested resource, browser and system information, and status codes) is processed to ensure secure, stable website operation and defense against cyberattacks (overriding legitimate interest pursuant to Article 31(1) FADP). Specialized IT infrastructure providers (including Cloudflare Inc.) are used for hosting, secure delivery and firewall protection (CDN/WAF).
3. Order processing, customer communication and batch documentation
When you order products via noson.ch or contact us, we process your contact, order, payment, delivery and correspondence data. Processing takes place for contract initiation and performance (Article 31(2)(a) FADP), to comply with statutory accounting and documentation obligations, and to safeguard our overriding legitimate interests (Article 31(1) FADP) in complete dispatch, seal and batch documentation for hygiene products, examining service enquiries, and establishing or defending legal claims. Please do not submit medical diagnoses or sensitive medical records via general contact channels.
4. Disclosure to independent service providers and cross-border transfer (Art. 16 et seq. FADP)
Personal data is disclosed exclusively insofar as necessary for payment processing, manufacturing, quality inspection and delivery by legally independent logistics and manufacturing partners, IT operations, or for safeguarding and enforcing legal interests towards legal counsel, courts or authorities. Because Unity Shield LLC has its statutory seat in the USA (Sheridan, Wyoming) and uses international IT and payment providers, personal data may be transferred to the USA and the European Economic Area (EEA). Cross-border disclosures take place on the basis of adequacy decisions of the Swiss Federal Council (Article 16(1) FADP, including the Swiss-U.S. Data Privacy Framework), recognized standard data protection clauses (Article 16(2)(d) FADP), or for direct contract performance and legal enforcement (Article 17(1)(b) and (c) FADP).
5. Cookies and local storage
noson.ch uses technically necessary cookies and local browser storage entries for language selection, shopping cart, checkout and security functions. Optional analytics or third-party functions are activated only upon corresponding settings or consent.
6. Retention period
Personal data is stored for as long as necessary for the respective processing purposes, contract and service administration, compliance with statutory retention obligations (in particular Article 958f OR), and for safeguarding, exercising and defending legal claims within the statutory limitation periods (in particular Articles 127 et seq. OR).
7. Statutory limitations and reservation regarding abuse (Art. 26 FADP / Art. 19 DPO)
Enquiries relating to personal data always require prior unambiguous proof of identity. Pursuant to Article 26(1) FADP and Article 25(4) FADP in conjunction with Article 19 DPO (DSV), disclosure or erasure will be refused, restricted or deferred, or made subject to an advance cost contribution and fee in the case of disproportionate effort or abusive requests, in particular insofar as data processing or retention serves statutory obligations, overriding interests of Unity Shield LLC, or the establishment, exercise or enforcement of legal claims.
